|
Q: What
data is necessary to use the Arrears Calculator? |
|
A:
To use the Arrears Calculator you will need to have an existing order (agreement)
for child support (for example, $500 per month from April 4, 1992 through May 15,
2004). You will also need a record of the payments, charges, and adjustments that
have been made on the order. Your order will tell you if interest is being charged
on the arrears. If there are any withholdings on your order, you will also need
that information.

|
Q: What
does the term "arrears" mean? |

The formal definition of arrears is "the state of being behind in the discharge
of obligations". Simply put, your case has arrears if the obligor is delinquent
in his/her child support payments.

|
Q: How
do I know if I can go after my "ex" for interest on arrears? |
|
A:
Currently, about half of the states in the US allow the custodial parent to receive
interest from the obligor. However, just because your state allows interest, you
are not automatically entitled/required to receive/pay interest. A judge must specifically
order interest be paid on the arrears in your order..

Q: How

|

The Arrears Calculator presents you with a log of every transaction within your
case. It can be used for your own record-keeping purposes or to prepare for court
proceedings. The Arrears Calculator determines how much is owed on your child support
order.

|
|
Q: When/how
often should I recalculate my arrears using the Arrears Calculator?
|
|
A:
After years of working with county child support agencies, we have seen firsthand
that the debt balances on the majority of child support cases are incorrect. The
Arrears Calculator should be used whenever the accuracy of the debt balance on your
case is at question. It can also be used to determine the debt balance on your case
prior to court hearings. The debt balance on your case can change from month to
month or week to week, depending on the frequency of your order and how often the
obligor actually makes payments. As such, it is important to keep your Arrears Calculator
account up to date. You may add payments, adjustments, etc. for free. You are only
charged when you calculate the totals on your case.
